The idea for this book came from a problem I have watched repeat itself across four decades and hundreds of matrimonial files: a client arrives with a long, painful, and often disorganised history, and the advocate's real skill lies in identifying the handful of facts that actually constitute the legal case. In dowry matters this difficulty is compounded, because marriage, gifts, demands, harassment, property, electronic communications, medical records and family disputes overlap in ways that a purely narrative account cannot easily separate.
I have therefore built this book around a discipline I ask every junior in my chamber to follow from the first conference: prepare a master chronology, an accused-wise role chart, a demand/payment chart and an evidence chart before drafting a single line of pleading. These four documents remain useful from the first client meeting through the final argument, and they are reproduced as working templates in the appendices so a reader can put them to use immediately.
This book also insists — repeatedly, because the point is repeatedly missed in practice — that the Dowry Prohibition Act, the BNS, the BNSS and the BSA must be read together, while matrimonial and domestic-violence proceedings retain their own separate statutory tests. A young advocate should never treat a criminal complaint, a domestic-violence application and a matrimonial petition as interchangeable drafts of the same story. Each has its own ingredients, its own forum, and its own relief.
