The journey of workplace dignity in India is neither ancient nor effortless. It is the product of struggle, judicial sensitivity, and social awakening. Before statutory recognition, women facing sexual harassment at the workplace were left with fragmented remedies under criminal law — remedies often inadequate to address the nuances of power imbalance and institutional silence.
The turning point came with the landmark judgment of the Hon'ble Supreme Court in Vishaka v. State of Rajasthan (1997), where, in the absence of enacted law, the Court laid down binding guidelines to safeguard women's fundamental rights under Articles 14, 15 and 21 of the Constitution of India.
This book traces the evolution of the POSH framework — from its judicial genesis in Vishaka to its statutory embodiment in the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. It examines not only the ethical foundations and case law but also the practical working of institutional mechanisms such as the Internal Committee and the Local Committee, with the aim of serving as a working guide for advocates, employers, Committee members and scholars alike.
Special attention has been given to model complaints, notices, replies, inquiry proceedings, recommendations and orders, so that the reader understands not only the substantive law but its everyday application. Important judicial pronouncements have been woven through the text to illustrate how the governing principles have evolved and continue to evolve.
It is hoped that this work will contribute to greater legal awareness and encourage every employer to build a workplace founded on dignity, mutual respect, equality and accountability. The true success of this law lies not merely in punishing offenders but in fostering an environment where every individual can perform their professional duties with confidence, safety and self-respect.
This book had its beginnings far from any courtroom — at an international seminar on Sustainable Economic Growth and Indo-Thai Strategic Co-operation in Bangkok, Thailand, where a conversation on workplace ethics across cultures first crystallised the idea for this work. I submit it now with the sincere hope that it will serve as a practical reference for the legal profession and for every stakeholder entrusted with the responsibility of ensuring dignity at the workplace.
