Description

WHEN PASSPORT OFFICES DEFY THE COURTS: Ten-Year Passport: A Right, Not a Favour

Ten years is the law. So why does the passport office give you one?

Under Rule 12(1) of the Passport Rules, 1980, an ordinary adult passport is valid for ten years. Yet across India, citizens with a pending criminal case are routinely handed a one-year passport, often with no written order and no reasons, even after a court has permitted renewal.

When Passport Offices Defy the Courts explains what the courts have actually decided. It brings together twelve judgments of the Bombay, Delhi, Madras, Rajasthan, Gujarat and Andhra Pradesh High Courts, from 2014 to 2026. In plain language, it sets out:

when a ten-year passport must be issued, and when it need not be
why passport validity and permission to travel abroad are two separate questions
how the 1993 Notification (G.S.R. 570(E)) has been misapplied to cut passport validity
why an FIR alone, without the court taking cognizance, does not bring Section 6(2)(f) into play
how to challenge an arbitrary one-year passport before the High Court

Inside you will find:

digests of twelve principal judgments, with full citations
a quick-reference table of key cases
a practical checklist for advocates, covering grounds and reliefs
a plain-language guide for citizens facing a pending case
recommendations for reform of passport office practice

Written by Bharat Bhushan Pareek, Advocate, the book is for advocates, law students, and every citizen who has stood at a passport counter with a court order and been told “one year only.”

This book provides legal information for educational purposes and is not a substitute for advice on the facts of a particular case.
